When the wall was built the half standing on lot 3 was the absolute property of the owners of that lot -- the only modification on their ownership was that they could not pull the wall down without the consent of the owner of Lot 4 they wer not bound to contribute towards the expense of the wall because it was built on their land or because they used it they wer only bound to contribute to the expense of building the wall because they had promised to do so.
