Memorandum by Mr. Elijah Hicks: Red Clay Oct 27. 1935 Tuesday. The Delegation met Mr Schermerhorn in the Committee Council House, where the said Schermerhorn exhibited his appointment as Commissioner, consisting of an Entreat of a letter from the Secretary of War, stating that he had been appointed Commissioner to negotiate with the Cherokee East.

      The Delegation gave an opinion that they had no reason to question his appointment and that, until the Commissioner submitted to them distinct written propositions, they would have nothing before them for their definite action. 
      The Commissioner then stated that he would submit distinct propositions for a Treaty on tomorrow, and requested that a Sub Committee should be appointed by them, to assist him in framing his propositions; - it would expedite the negotiations : otherwise, if he had to make out the articles within himself, the Delegation would reject them as often as they were submitted. He did not wish to be so "trifled with." 
      The Commissioner finally concluded to make his propositions on Tomorrow. 
     
     "The following are copies of the papers presented by Mr Schermerhorn as his credentials. "War Department "April 2nd 1835. "Gentlemen "I have the honor to inform you that the "President has appointed you Commissioners to negotiate the Cherokee Indians East- of the Mississippi River."
