During the consideration by the Delegation as to whether the papers produced by Mr Schermerhorn should be Template:Unclear as sufficient credentials, Mr S. retired. The discussion ended in the drawing up of the following memorandum by the Mr. Rofs, which was read to Mr. Schermerhorn, on his being called back into the room, and left with him: "From the Extract of the Honorable Secretary of War's Letter, presented before the Cherokee Delegation by Mr Schermerhorn, it appears that Gov Carroll and Mr Schermerhorn have been notified that "the President has appointed them commissioners to negotiate with the Cherokee Indians East of the Mississippi River" but they have no evidence before them, to determine whether he has or has not be commissioned: However, be it as it may, until Mr Schermerhorn submits a distinct written proposition before the Delegation, they will have nothing before them to deliberate and act upon.
