they shew that this right so far as the immediate possession and jurisdiction were concerned, extended only to such lands as had been voluntarily relinquished by the Indians or should be gained strikeout: by rom them by military conquest; and they prove this by the constant declarations as well as practice of the British crown. This right of discovery, then, as understood by enlightened nations in modern times, results in the acquisition of the ultimate domain; -- in a limited sovereignty, and in a mere right of pre-emption, to the exclusion of all other competitors, leaving the Indians free to sell or not; and in the mean time to govern themselves on their own limits; -- or, in forcible conquest made in a course above word: cause? of war by the Sovereign having the power of declaring war; and never has this pretended right been carried farther against the Indians, since the true light of the gospel, and the humanity, justice and equity which it has introduce, have superceded the darkness and ferocity of superstition and despotism. But the government writer, recoiling from the modern understanding of this right, and finding no foothold for this unlimited claim of Georgia, in the doctrines of the present age, and still less in the Constitution, laws and treaties of the United States, has gone back for his idea of the right of discovery to the barbarous night of the fifteenth century, when the mode strikeout: of adopted by nominal christians of recommending the christian religion to Indians was by hunting them to death with blood hounds, or roasting them alive on beds of burning coals. He even begins with the papal bull of 1493, by which the wicked and presumptuous Pope of Rome affected to divide the newly discovered world between the crowns of Spain & Portugal. This papal bull, which has been the theme of alternate ridicule and indignation among all enlightened historians * statesmen of modern times, is now, in the nineteenth century, taken as the foundation stone of the political fortress, behind which this government writer seeks to protect and defend this usurpation
