58 The Judges of the Supreme Court having submitted to the National Committee the difficulty arising from four Judges dissenting from the decision of a certain question, by the Judiciary being entirely deficient, whether a majority of Judges shall rule the decision of the court, or not, it is therefore the opinion of this body that the opinion of the majority of the Judges of the said Court be sufficient to decide all matter of controversy that way he bought before them except in cases of capital crimes, then, in such cases, the unanimous opinion of said Judges shall be sufficient.
