here sent word to Capt Stough that on a certain day at three oclock he would be on the Top of a certain hill here and that he would fight all the soldiers until they killed him said he didn't want to be taken to jail as unclear but that he wanted to die fighting. Capt Stough wouldn't listen to it but on the day the Indian was on the hill unsure all the Cheyenne came and gathered around the hill all well armed The State had 4 marshals here to arrest the man but the Capt wouldn't allow it as if they had all the Indians would of fought them and the troops
