Themselves faithfully in the prosecution of the trade — they shall employ all traders, clerks, & other persons as shall be necessary to carry on the business — in short, they shall devote their time + attention to advance the interest of “ Upper Misc. Article 4th.  The parties hereto shall meet annually in the month of July at Sr. Louis, when + where a settlement shall take place, and a statement be made of the affairs of the outfit, when a dividend of the profile or losses shall take place. all salaries and other allowances not therein specified, shall be considered due and payable on the annual setting day.
 
Article 5th - The parties hereto of the second part are to be furnished at the expense of the Outfit in the suitable board lodging, Any goods taken by either of said parties for his own use shall be changed so as to yield to the Outfit a clean gain of few Cent.
 
Article 6th. All the times, shins or other property obtained in the prosecution of the trade contemplated by their agreement, shall as early as practicable in each year, be shipped to Sr. Louis, where said parties of the first part shall make an offer to the Outfit for the entire collection. Should said offer not be acceptable by said parties of the second part, said return shall be sold at St.Louis if a larger bid can be obtained therefor, or they shall be shipped to New=York to be disposed of for the account of the Outfit, the parties of the first part shall be entitled to change five per cent upon the need proceeds of said sales, which as always to be closed, not later than the month of June following the shipment from St. Louis.

This mutually covenanted & agreed by & between the parties hereto, that the trade under this agreement shall be carried on for the term of four years, that is to say, it shall commence on the first day of August next, [1842] and shall close in the year one thousand eight hundred & forty six, ( indeed renewed by consent of the parties hereto,) when the Outfit of the previous year shall have been closed. The whole interest in the trade shall be divided into forty eight equal parts - of which said Pierre Chouteau Junior & Co. shall hold twenty four- Hercules L. Dousman eight - Henry H. Sibley eight - and Joseph Rolette eight - in which said properties the said parties are annually to share the or loss which may have accrued.
