by the State of Georgia to put down this new State, attempted to be organized within her jurisdiction, the Cherokee Government passed the following Act: "Whereas a law has been in existence for many years, but not committed to unity, that if any citizen or citizens of this nation shall treat + dispose of any lands belonging to this nation, without special permission from the national authorities, he or they shall suffer Death; Therefore Resolved, By the Committee + Council in General Council Convened, that any person or persons who shall, contrary to the will + consent of the legislative council of this nation in General Council Convened, enter into any Treaty with any Commissioner or Commissioners of the United States, or any officers instructed for the purpose, and agree to sell any part or portion of the national lands defined in the constitution of this nation, he or they do offending, upon conviction before any of the circuit judges, or the Supreme Court aforesaid, shall suffer death; and any of the circuit Judges aforesaid are authorised to call a court for the trial of any such person or persons who shall violate the provisions of this act, and shall refuse by resistance to.appear at that place designated for.trial, - or abscond, - are hereby declared outlaws, and any person or person's, citizens of this natikn, may kill him or them so offending in any manner most convenient, within the limits of this nation, + shall not be held accountable to the laws for the same. Be it further Resolved, that if any citizen or citizens of this nation, shall enter into a Treaty with the United States Govern!ent for any object whatever other than cession of land, he or they upon conviction shall be punished with one hundred lashes on the bare back; + no treaty shall be binding upon this natikn, which shall not have been ratified by the General Council, and approved by the principal Chief. The Act needs no comment of mjne. I will only state the fact that this has prevented + still prevents many who are in favor of a treaty, from manifesting it; and it was under this act that John Walker was way laid + murdered last uear, because he was supposed favourable to a Treaty then proposed to the nation. There have been at east four or five killed this summer past, !merely because they enrolled under he presentTreaty, and the lives of others daily threatened to be destroyed. According to the constitution adopted for the Cherokee Govern!ent, there is not now a single individual belonging to the Red Clay Council, with John Ross at their hesd, leagally+ constitutionally in office.
"The Cherokee Constitution: Article3d..Secn3d..-The Committee shall consist of two members from each district, and the Council shall consist of three members from each district, to be chosen by the qualified electors of their respective districts for two years; and the elections to be held in every district in the first Monday in August for the year 1828 and once a year, to be convened in the Second Monday in October in each year at New Echota."
